Leader of opposition in state assembly Gulab Chand Kataria, BJP chief Satish Poonia, former state unit chief Arun Chaturvedi and former minister Rajendra Rathore held a meeting in Jaipur on Wednesday morning to discuss the “constitutional position” of the notice issued to Congress MLAs by assembly Speaker CP Joshi.
“We discussed the constitutional aspects of the notices issued to the 19 MLAs. Since we are the main opposition, we discussed the various aspects of the issue. We will wait and watch how the situation develops,” Pooniasaid.
Speaker’s notice has been issued under Rule 191(2), which states that an MLA can be disqualified for defying a whip. Joshi has given MLAs time till Friday to reply, failing which they may be disqualified.
“The charge of disobeying a whip applies only inside the House. There are SC and HC judgements,” Chaturvedi claimed.
He cited the Parkash Singh Badal versus Union of India case of 1987 in the Punjab and Haryana HC; Rajasthan Speaker’s ruling in Janata Dal’s merger with BJP and the 2016 SC ruling in Nabam Rebia versus deputy speaker, Arunachal case.
