The SIT agreed with Chinmayanand's point against the girl of a "8-month-long plot" while arguing against the bail to the girl in the extortion case.
New Delhi: Former BJP MP Swami Chinmayanand argued before the court that "getting oil massages may be immoral but not illegal" and claimed that no video showed him doing sexual intercourse but court denied him bail, terming charges made by the Shahjahanpur girl against him in a judicial statement as "very serious".

ET has accessed the court orders by which bail was rejected on September 30 for both Chinmayanand and the girl in the respective cases lodged against them. As per the court order, the BJP leader put up an elaborate argument before the court, even citing his performance as the former Minister of State for Home in the central government and his role in the Ram Temple movement. "As MoS Home, he got the Bodo agitation finished in his term and ensured surrender of 2600 Bodo militants and inspired them to work for the country. He was also very active in the Ram Janmbhoomi movement," Chinmayanand's lawyer told the court. His philanthropic record in Shahjahanpur was cited and it was claimed that he got ayurvedic massages on a doctor's advice due to skin diseases. But court did not accept such arguments.

Chinmayanand also argued that he was asked for Rs 5 Cr as extortion in a plot hatched over eight months and the girl's accomplice Sachin Sengar had first met him at his house on August 9 asking for the amount. The SIT agreed with Chinmayanand's point against the girl of a "8-month-long plot" while arguing against the bail to the girl in the extortion case. The prosecution also cited 230 calls between the girl and Chinmayanand between June and August totalling almost six hours of conversations and said when the extortion message was sent o Chinmayanand over WhatsApp on August 22, the girl was along with three of her co-accused friends. The non-bailable Section 67 of IT Act has also been put on the girl as SIT claims she was part of the plot of sending a obscene image to Chinmayanand along with the extortion message.

Anoop, a taxi driver who surriptuosly shot a video of the girl and her friends allegedly discussing the extortion plot in his car, is now a star witness in the extortion case and SIT has also got his statement recorded before a Magistrate.

Both Chinmayanand and the girl are presently lodged in the Shahjahanpur jail.
