Uddhav Thackeray: Our claim to form government is still valid
Uddhav, Shiv Sena chief: Yesterday we formally requested Congress-NCP for their support to form the government. We needed 48 hours, but the Governor didn't give us time. Govenor had given us only 24 hours. Which is less than that for BJP.

Shiv Sena lawyer: SC has asked us to mention the writ that we filed tomorrow morning at 10.30 before court. They have informed us that it will not be possible to constitute a bench today . The fresh/second petition challenging the imposition of President Rule is being readied. The decision on when to file it will be taken tomorrow.

What Article 356 (1) says
As per Article 356(1): "If the President, on receipt of report from the Governor of the State or otherwise, is satisfied that a situation has arisen in which the government of the State cannot be carried on in accordance with the provisions of the Constitution, the President may by Proclamation
(a) assume to himself all or any of the functions of the Government of the State and all or any of the powers vested in or exercisable by the Governor or any body or authority in the State other than the Legislature of the State;
(b) declare that the powers of the Legislature of the State shall be exercisable by or under the authority of Parliament;...."
In Maharashtra, the Governor had given time till 8:30 pm today to NCP to prove to him that they can command a majority. But before that deadline expired, he sends a recommendation to the Centre saying that no government formation is possible and so President's Rule should be imposed. You yourself gave that time. This is something unacceptable.

No decision taken yet by SC registry on listing Shiv Sena's petition for hearing
The Supreme Court registry is yet to take a call on placing the petition filed by the Shiv Sena before Chief Justice of India Ranjan Gogoi on their plea for according an urgent hearing on Tuesday itself. An official source told PTI that there is some defect in the petition and the judicial branch of the the apex court registry is working with the advocate-on-record who has filed the petition to cure the defect. The official said that the decision to place the matter before the CJI will be taken only after the defects are cured.

After Shiv Sena filed a petition in the Supreme Court against Governor Bhagat Singh Koshyari, Maharashtra government standing counsel, Nishant Katneshwarkar said appropriate steps will be taken after going through Shiv Sena's petition. "I came to know about the filing of a petition by Shiv Sena challenging a communication by the Governor by which its claim has been rejected with regard to the formation of the government. We will take appropriate steps after going through the prayers and grounds in the petition," Katneshwarkar told ANI.
