Videocon Industries Disclosure Of Replacement Of The Resolution Profession

The NCLT vide its order dated September 25, 2019 (published on September 27, 2019) has now approved the replacement of the Erstwhile Resolution Professional with Mr. Abhijit Guhathakurta as the resolution professional for the consolidated CIRP of the Corporate Debtors ("Order of Replacement"). A copy of the Order of Replacement was made available on September 27, 2019 when the same was uploaded on the website of the NCLT.

If SBI is allowed to execute sale as advertised, the Videocon group may suffer an irreparable loss.

"The SBI is hereby prohibited to go ahead with the advertisement and directed to maintain the status quo till the decision is pronounced on merits", said NCLT.

The ministry had on October 22 last year sent Videocon a demand notice for payment of government's share of profit.

The Honble National Company law Tribunal, Mumbai Bench ("NCLT"), vide its order dated 08th August, 2019 ("Order") has admitted the petition for consolidation of the CIRP of 13 Videocon group entities.Further, the Honble NCLT approved the appointment of Mr. Mahender Khandelwal (Registration No. IBBI/IPA-001/IP-P00033/2016-2017/10086 ) as Resolution Professional (RP) and, accordingly, he has taken over the CIRP of the 13 Videocon group companies inter-alia including the control of the management and operations in terms of the provisions of the Insolvency and Bankruptcy Code, 2016 (the "Code"). We are enclosing herewith a copy of the order dated 08th August, 2019 passed by the Hon ble National Company Law Tribunal, Mumbai Bench for your information and record.

If assets are not sold, the share which would have come to the Indian co will go to an Indonesian firm.

The move comes after a consortium of lenders led by the SBI have invited bids for the group's Brazilian and Indonesian assets via ads.
